Terms of Service

By creating an account or using the BeFitWay app, you expressly agree to these Terms of Service and to our Privacy Policy. If you do not agree with any provision, please do not use the platform or its related services.

BeFitWay is a nutrition tracking, healthy habit support and routine logging tool powered by artificial intelligence. Calculations, meal suggestions, calorie estimates and recommendations are strictly educational and informative. They are not medical advice, clinical diagnosis or individual nutritional prescription. Always consult a qualified health professional before starting restrictive diets or new exercise programs.

To use certain features, you must provide true, accurate and up to date information when you sign up. You are solely responsible for keeping your login credentials confidential and for any activity carried out from your account.

You agree to use BeFitWay in strict compliance with applicable laws. You may not: (a) post offensive, unlawful or discriminatory content in the community; (b) try to bypass security or authentication mechanisms; (c) reverse engineer the code; (d) use bots or automated data extraction tools without prior written authorization.

To keep BeFitWay safe, the following is prohibited: (a) nudity or sexual content; (b) harassment, threats, hate speech or bullying; (c) fake profiles or impersonating someone else; (d) spam, scams or unauthorized sales; (e) encouraging eating disorders or the use of dangerous substances; (f) exposing another person's personal data.

Zero tolerance for abuse or exploitation of minors: the account is banned immediately and the case is reported to the authorities.

You can block anyone from their profile and report posts from the feed or by email at suporte@befitway.com. The team reviews every report and may remove the content, suspend or ban the account.

Fit Connections and Messages: only for people aged 18 or over with active access to the app. A chat only opens when both people like each other (match). You choose whether you appear to other people and you can unmatch, block or report at any time. The rules above also apply to messages, and sending links or phone numbers or asking for money is prohibited. Giving a false age leads to a ban.

Some advanced features are offered through recurring subscription plans. Prices and billing terms are shown clearly before you confirm the purchase.

Right of withdrawal (Article 49 of the Brazilian Consumer Protection Code): you may cancel the purchase within 7 (seven) calendar days from the subscription date or from the first paid access, with a full refund.

Purchases through the Apple App Store or Google Play Store: if you subscribed through the Apple or Google app stores, payment processing and refund requests are handled directly by those platforms, under their own support policies.

Web purchases and direct payments: for purchases made directly on our website, cancellation and refund requests must be sent to suporte@befitway.com within the 7 day legal period.

BeFitWay uses local storage (LocalStorage) and session cookies that are strictly necessary for secure authentication, to keep your display preferences and to keep the app running reliably. We do not use invasive cookies and we do not sell data to third parties for cross site ad tracking.

The meal photos, measurements, posts and records you send remain yours and under your responsibility. You represent and warrant that you hold all rights and permissions over any media you upload, without infringing copyright, image rights or trademarks of third parties.

By sending content to BeFitWay, you grant the platform a limited, non exclusive and royalty free license for technical processing and for improving the internal computer vision models, as described in the Privacy Policy.

Notice and takedown (Article 19 of the Brazilian Internet Civil Framework): any copyright holder or user who finds offensive or unlawful content, or content that infringes intellectual property, may request its suspension or removal through the report button in the feed or by email at suporte@befitway.com. BeFitWay will review the request promptly and remove the infringing material, protecting the good faith and integrity of the community.

BeFitWay is provided "as is" and "as available". Although we apply strict software engineering and cybersecurity standards, we do not guarantee that the service will run without interruption or free from third party outages. Under no circumstances will BeFitWay be liable for indirect damages arising from the use of the platform.

You can cancel your account or request the permanent deletion of all your data at any time, directly in the app settings through the account deletion flow or by emailing our privacy channels.
